ORDINANCE NO. ______

AN ORDINANCE TO ESTABLISH A PARKS AND RECREATION CITIZEN ADVISORY BOARD;

AND FOR OTHER PURPOSES

 

WHEREAS, the purpose of this Ordinance is to establish a Parks and Recreation Citizen Advisory Board to advise Texarkana, Arkansas, Board of City Directors and staff on how to best provide safe and comprehensive parks and recreation facilities, programs, and services on behalf of all current and future residents of the City of Texarkana, Arkansas; and

WHEREAS, in order to increase community involvement it is in the public interest for the City of Texarkana, Arkansas, to establish an Parks & Recreation Citizen Advisory Board;

NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS FOR THE CITY OF TEXARKANA, ARKANSAS, that there is created Article IV to Chapter 17 entitled “Parks and Recreation Citizen Advisory Board” containing the following numbered Sections:

Sec. 17-70:  Creation of Parks and Recreation Citizen Advisory Board.  There is hereby established a Parks and Recreation Citizen Advisory Board for the purpose of making written suggestions to the Board of Directors or, via the City Manager, the Parks Superintendent for the City of Texarkana, Arkansas, designed to provide safe and comprehensive parks and recreation facilities, programs, and services on behalf of all current and future residents of the City of Texarkana, Arkansas.  The board created by this Article is advisory in nature only and not a policy implementing body.  Nothing contained in this Article (including, without limitation, establishment of the board created hereby) shall be deemed to limit the authority of the Board of Directors, the City Manager or any employee, department or other board or commission of the City of Texarkana, Arkansas, now or hereafter existing.  The board created by this Article shall have no authority to expend City funds, bind the City, or involve itself in any City employee or employment matter.  Nothing contained herein shall require the consideration of or implementation of any suggestion of the board created by this Article, nor to mandate or imply that the City Manager, Parks Superintendent or any employee of the City of Texarkana, Arkansas, is otherwise accountable to the board created by this Article.

            Sec. 17-71:  Membership, Terms, Attendance, Vacancies. 

(a)   Voting Members.  The Parks and Recreation Citizen Advisory Board, shall consist of no more than nine (9) voting members, appointed (as necessary from time to time) by a majority vote of the Board of Directors, each of such members shall reside in the City of Texarkana, Arkansas, as follows:  one member from each ward; one member from the City at large; one member that is a student in the Ninth (9th), Tenth (10th), Eleventh (11th) or Twelfth (12th) Grade and enrolled in an Arkansas public school system school located in the City of Texarkana, Arkansas; and, one member who is also a member of the Quorum Court of Miller County, Arkansas. 

(b)   Ex Officio Members.  The Parks Superintendent for the City of Texarkana, Arkansas, and the Assistant Public Works Director for the City of Texarkana, Arkansas, shall be Ex Officio members of the board created by this Article and may participate in meetings and discussion, provided that such ex officio members shall not be entitled to vote on any matter or count for any purpose as relates to establishment of a quorum or conducting business.

(c)   Term of Office.  Voting Members of the board created by this Article shall have regular terms as follows:  Members appointed for one of the ward positions or at large positions shall have 4 year terms coinciding with the term of the position of the Director from or, for the at-large position, the Mayor (it being recognized that the initial term of members of the board created by this article may extend a full four years) and members appointed for the school or county positions shall have two year terms.  In the event that a member no longer qualifies for the position he or she holds, then that member’s seat shall be deemed vacant.  No voting member may serve more than two consecutive terms (or portion thereof in the event of service of a partial term) on this board without at least two years passing since last holding a position on such board.  

(d)   Attendance.  In the event that a Voting Members misses more than three (3) consecutive meetings, the remaining members of the board may elect, by majority vote of the remaining member to declare the position vacant.  

(e)   Vacancies.  Should any member of the board created by this Article fail to serve his or her entire term, the Board of Directors may appoint a person to complete any unexpired term.

Sec. 17-72:  Chairperson and Vice-Chairperson, Meetings, Agenda, Compliance with Law.

(a)   The Chairperson and Vice-Chairperson shall be a voting member of the board created by this Article and elected by a majority vote of the members of the board created by this Article.  Each position shall have a term of two (2) years, whereupon successors shall be elected.  No person shall be eligible to serve as Chairperson or Vice-Chairperson for more than a single term in such position (or portion of a single term) without at least two years passing since last holding such position.  In the event of a vacancy in either position of the positions of Chairperson or Vice-Chairperson prior to expiration of the term thereof, the board created by this Article shall elect a successor (voting member) for the remainder of the unexpired term of such position.

(b)   The Chairperson shall preside in all meetings.  In the event of the absence of the Chairperson or vacancy in such position, the Vice-Chairperson shall so preside. 

(c)   All meeting of the board created by this Article shall be conducted in accordance with the most current version of Roberts Rules of Order; provided, that the Agenda shall be prepared by the Chairperson (or, if the position of Chairperson is vacant, the Vice-Chairperson) and shall include all items requested by a voting member of the board prior to the calling of a meeting.

(d)   Regular Meetings shall be held on a regular schedule and at a regular location as set by the board created hereby.  Special Meetings shall be called upon not less than two (2) hours notice upon the initiative of the Chairperson or upon the request of two (2) voting members of the board created by this Article. 

(e)   The advisory board created hereby shall at all times comply with applicable local, state and federal law.
