  1. Adopt an Ordinance authorizing the City Manager to purchase three new fire trucks and associated equipment from Emergency Vehicle Specialists, Inc. (TAFD) Chief David Fletcher

 

  1. This ordinance requires an emergency clause: An emergency clause requires a separate and distinct vote of the board and is valid only if there is a two-thirds vote of approval by the board. (Hdbk. Const. Amend 7)

SUMMARY: After extensive research, the Fire Department has selected a Pierce brand 107ft Aerial Apparatus and two Pierce brand commercial pumpers to add to our fleet. The regional dealer for Pierce trucks is Emergency Vehicle Specialists. Bids were obtained and compared from three different manufacturers through the Houston-Galveston Area Cooperative Purchasing Program. The acquisition of these three trucks will ensure the quality of our fleet for many years to come.     

BOARD ACTION: The City Manager and staff recommend Board approval.

EMERGENCY CLAUSE:  Due to the importance of this purchase, this ordinance requires an emergency clause.

 

 

ORDINANCE NO. ______

AN ORDINANCE AUTHORIZING THE CITY MANAGER TO PURCHASE THREE NEW FIRE TRUCKS AND ASSOCIATED EQUIPMENT; WAIVING ANY APPLICABLE COMPETITIVE BIDDING PROVISION; FOR DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

 

WHEREAS, it is necessary to purchase three new fire trucks and associated equipment therewith to provide for the health and safety of the citizens and businesses of the City; and

WHEREAS, the Texarkana, Arkansas, Fire Department (TAFD), advertised for bids via a buy-board managed by the Houston-Galveston Area Cooperative Purchasing Programs, provided, however, the selection and design of machinery and related equipment of this nature is highly specific, specialized and unique, all depending upon the public safety provider’s specific public safety needs and related factors, making traditional competitive bidding comparison impractical and not feasible in each instance; and

WHEREAS, pursuant to Ark. Code Ann. §14-47-138, the Board of Directors may waive the requirements of competitive bidding in exceptional situations where competitive bidding is not feasible; and

WHEREAS, while use of a state buy board for bidding, as permitted by City Ordinance, was undertaken by TAFD and every effort made by TAFD to maximize the use of previously budgeted funds herein, should the purchase of the fire trucks and associated equipment contemplated by this ordinance, or any portion thereof, require or be later determined to have required a waiver of competitive bidding, the approval of the purchase is being made by ordinance specifically recognizing such waiver as permitted by applicable law; and

WHEREAS, the specific purchase prices for the trucks designed and associated equipment are as follows:

1.      One Pierce brand 107-foot Aerial Apparatus and associated equipment:  $890,710.00

2.      Two Pierce Brand Pumpers and associated equipment:  $304,645.00 each

WHEREAS, the low-bid supplier for this equipment identified through the above referenced buy-board and with whom specific machinery and equipment needs and requirements was discussed and addressed is Emergency Vehicle Specialists, Inc.; and

 WHEREAS, TAFD and the City Manager request approval of the purchase of the trucks and equipment identified above and, further, waiver of any applicable competitive bidding practices, all as and for the reasons described above;

NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Texarkana, Arkansas, that:

Section 1:       The purchase of the three fire trucks and associated equipment described above is approved and any competitive bidding practices that may be otherwise required by applicable law and ordinance are waived.

Section 2:       The City Manager is authorized to enter into any agreement reasonably necessary to carry out the purchase of said fire trucks and equipment on the terms and conditions set out above.   

Section 3:       This action being necessary for the preservation of the public peace, health and safety (including, without limitation, the need to immediately confirm acceptance of the bids and associated proposals, cause the machinery and equipment to be ordered, and procure new public safety equipment), and a separate and distinct vote having been taken on this emergency clause, an emergency is therefore declared to exist, and this ordinance shall be in full force and effect from and after its passage and approval.
