SUMMARY: Consider an ordinance to amend and provide for fees for permits and services in order to recoup expense incurred by Texarkana Water Utilities for issuance and performance of the same. Amendments include: the last sentence of Section 26-58(b)(1)(a) of the Code is deleted and Section 26-35 Misc. Fees is added to the Code (ATTH 01).

BOARD ACTION: The City Manager and Utility staff recommend approval.

EMERGENCY CLAUSE:  Master Fee list has already been approved by the Texas side.

AN ORDINANCE TO AMEND AND PROVIDE FOR FEES FOR PERMITS AND SERVICES IN ORDER TO RECOUP EXPENSE INCURRED BY TEXARKANA WATER UTILITIES FOR ISSUANCE AND PERFORMANCE OF THE SAME; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES

 

WHEREAS, it is necessary to amend and provide for fees related to certain mandatory permits and specific services issued and provided by Texarkana Water Utilities (the “Utility”) in order to recoup the reasonable expense incurred by the Utility for the same; and

WHEREAS, the City Manager, the Utility and Utility Staff recommend approval;

NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Texarkana, Arkansas, that the Code of Ordinances of the City of Texarkana, Arkansas, (“Code”) is amended as follows:

Section 1.  The last sentence of Section 26-58(b)(1)(a) of the Code is deleted.

Section 2.  The following is added as Section 26-35 of the Code:

Section 26-35Misc. Fees.  The following fees shall be charged by the Utility for the following:

 

Smoke Testing (upon request by Utility customer):  $100.00 for a 2-person crew for each 2-hour period, or portion thereof, of testing.

CCTV Mains (upon request of Utility customer):  $250.00 for a 3-person crew for each 3-hour period, or portion thereof, of testing, of CCTV main inspection work.

Fire Hydrant Flow Test (upon request of Utility customer):  $100.00

Backflow Testing:  $135.00 upon request or if otherwise carried out by Utility

Liquid Waste Transporter Permit:  $60.00

Septic Waste Manifest Book:  $15.00

 

Section 3.  This ordinance being necessary for the preservation of the public peace, health and safety, an emergency is therefore declared to exist; and this ordinance shall be in full force and effect from and after its passage and approval.

Section 26-35 Misc. Fees.  The following fees shall be charged by the Utility for the following:

 

Smoke Testing (upon request by Utility customer):  $100.00 for a 2 person crew for each 2 hour period, or portion thereof, of testing.
